Defense Verdict in Medical Malpractice/Wrongful Death Case
(November 2007) Cullen McKinney successfully represented three hospitals in a
Wayne County Circuit Court action, resulting in a defense verdict after nearly two
months in trial. Plaintiff alleged that the use of neutron radiation to treat prostate
cancer was experimental, should not have been prescribed and was improperly
administered. After the lengthy trial, the jury deliberated for one day and returned
a unanimous verdict for all defendants.


No Negligence in Endocrinology Death Case

(September 2007) Bill Tanoury recently added to his string of defense verdicts.
Bill represented an endocrinologist in a case involving an alleged failure to properly
manage a patient's diabetes, hypertension and hyperlipidemia, leading to an acute
myocardial infarction and death of a 43 year old automotive designer. At the
conclusion of the six day trial the jury deliberated for 90 minutes before returning
a verdict of no negligence.


Defense Verdict in Wrongful Death Case

Bill Tanoury and Susan Beutel recently successfully represented an emergency
medicine specialist at trial in Washtenaw County Circuit Court, obtaining a defense
verdict after five days in trial. The plaintiff alleged a failure to diagnose and properly
treat a head injury, resulting in the patient's death. The jury disagreed, finding no
negligence in the physician's care of the plaintiff.

This verdict adds to Bill's long string of success at trial. Since 2000, Bill has tried
17 cases and has brought back defense verdicts in all but two cases.


Tanoury Corbet Prevails in Supreme Court

On June 27, 2007, Linda Garbarino and Anita Comorski received a favorable decision
from the Michigan Supreme Court in Washington v Sinai Hospital of Greater Detroit,
reversing the Court of Appeals and reinstating the dismissal entered by the trial
court in favor of the firm's clients. This important case resolved the question of
whether a plaintiff/successor personal representative could file a second action on
behalf of an estate after a previous, identical action filed by the prior personal
representative was dismissed with prejudice on statute of limitations grounds.

Garbarino outgoing chair of State
Bar Appellate Practice Section
Linda M. Garbarino will be concluding her tenure as the Chair of the State Bar of
Michigan Appellate Practice Section at the annual meeting of the State Bar of Michigan
on September 27, 2007 in Grand Rapids, Michigan.  Ms. Garbarino served as Chair of
the Appellate Practice Section beginning in September 2006. The Appellate Practice
Section consists of approximately 685 members of the State Bar of Michigan.
